Construction Worker Killed in Loop 101 Crash

According to a report from Fox 10 Phoenix, a construction worker was killed in a catastrophic work-zone crash on the on-ramp of Loop 101. The devastating wreck is still under a more comprehensive investigation by law enforcement. In this article, our Arizona workers’ compensation attorney explains what we know about the incident and discusses the considerable risk that highway construction workers face in Arizona.

Fatal Crash in Work Zone on Loop 101

As confirmed by reporting from Fox 10 Phoenix, a construction worker from Tolleson passed away after an early morning crash on a freeway on-ramp in Glendale. Based on a preliminary investigation, authorities believe that the crash happened around 5:15 a.m. on November 13th. The victim of the terrible collision was identified as 64-year-old Vicente Castellanos Rodriguez. Unfortunately, he was struck while working on the westbound Loop 101 on-ramp at 35th Avenue to reach a work zone on the north shoulder. A vehicle struck Mr. Castellanos Rodriguez as he stepped across the lane. He was taken to a hospital, but sadly did not survive. Mr. Castellanos Rodriguez had been working for a contractor assigned to freeway improvement projects in the area. The Arizona Department of Public Safety temporarily shut down the on-ramp. The deadly highway work-zone crash is still under a more comprehensive investigation.

Highway Construction Workers Face Serious Safety Risks

The Federal Highway Administration (FHWA) reports that approximately 100 construction workers are killed in roadway work-zone crashes nationwide each year. Many hundreds more suffer serious, even catastrophic injuries. Highway construction zones remain some of the most dangerous places to work because drivers frequently fail to slow down, change lanes safely, or maintain proper lookout when approaching active roadway projects. Sudden lane shifts, high traffic speeds, nighttime conditions, and distracted driving all increase the risk of a deadly event. Families are often left searching for answers after a tragedy that unfolded in a matter of seconds.

Arizona work zones see many of the same hazards. Large commercial trucks, impaired drivers, and aggressive speeding create conditions that place workers in constant danger. Although construction crews follow strict safety rules and wear high-visibility protective gear, they cannot control the behavior of motorists. When a fatal work-zone crash occurs, families need justice, accountability, and the maximum available financial support.

Options for Families of Highway Construction Workers Killed in a Crash in Arizona

Was your loved one killed while working in a highway workzone in Maricopa County or elsewhere in Arizona? It is imperative that your family knows how to effectively navigate the claims process. Our Arizona work accident team can help. Here is an overview of the options for families:

  • Workers’ Comp Claim (Death Benefits): In Arizona, workers’ compensation is the primary remedy against the employer when a worker is killed on the job. The governing statute is A.R.S. § 23-1046. The law provides death benefits to surviving dependents. These benefits include funeral expenses and ongoing financial support to spouses, dependent children, and sometimes other qualifying dependents. Workers’ comp is a no-fault system. In other words, the family does not need to prove that anyone acted negligently. The only requirement is that the death arose out of and in the course of employment. Although workers’ comp provides an important financial foundation, it has limits. It does not allow families to recover damages for pain and suffering, emotional distress, or loss of companionship. Benefits are calculated according to statutory formulas, not based on the full value of what the worker contributed to the family. For this reason, many families in Arizona also explore third-party claims when another driver, contractor, or equipment operator played a role in the fatal crash.
  • Wrongful Death Lawsuit (Third Party Liability): If a negligent third party caused or contributed to the crash, families may bring a wrongful death claim under A.R.S. § 12-611. Wrongful death claims allow recovery for the full range of losses caused by the fatal event. Eligible beneficiaries include the surviving spouse, children, and, in some cases, parents. These lawsuits differ from workers’ comp because fault must be proven. Evidence may include crash reconstruction, witness statements, work-zone design records, speed data, or toxicology reports. Damages in wrongful death suits are far broader than in workers’ comp. Families may recover for loss of financial support, loss of household services, funeral expenses, loss of companionship, emotional suffering, and the decedent’s lost future earnings. If the third party engaged in extreme recklessness, punitive damages may also be available. Importantly, the employer generally cannot be sued because workers’ comp provides immunity. However, any non-employer third party can be sued for wrongful death. That means families can sue contractors, subcontractors, motorists, commercial trucking companies, and any non-employer third party.

Note: Workers’ comp claims and third-party liability claims are not mutually exclusive. Your family should always pursue a workers’ comp claim after a loved one’s fatal workplace accident. Beyond that, you should explore every available option for a third-party liability lawsuit.
